The U.S. Attorney’s Office for the Southern District of California filed a complaint against the Iipay Nation for its Desertrosebingo.com website on December 3.  The complaint alleges that the Iipay Nation’s real money bingo site violates the Unlawful Internet Gambling Enforcement Act.

The action seeks:

A temporary restraining order, a preliminary injunction and a permanent injunction against Defendants, and each of them, to prevent or restrain Defendants from accepting, through the operation of Desert Rose Bingo, the following:

A. credit, or the proceeds of credit, extended to or on behalf of any Desert Rose Bingo Account Holder (including credit extended through the use of a credit card);

B. an electronic fund transfer, or funds transmitted by or through a money transmitting business, or the proceeds of an electronic fund transfer or money transmitting service, from or on behalf of any Desert Rose Bingo Account Holder;

C. any check, draft, or similar instrument which is drawn by or on behalf of any Desert Rose Bingo Account Holder and is drawn on or payable at or through any financial institution; and

D. the proceeds of any other form of financial transaction, as the Secretary and the Board of Governors of the Federal Reserve System may jointly prescribe by regulation, which involves a financial institution as a payor or financial intermediary on behalf of or for the benefit of any Desert Rose Bingo Account Holder.

Desertrosebingo.com launched for real money action on November 3, 2014.  There are also plans to launch PrivateTable for real money online poker games. PrivateTable currently allows play money action to anyone 18 years of age or older in California.

The Iipay Nation is in federal court today for a hearing related to its pending case involving California.  The state is seeking an injunction to cease the operation of Desertrosebingo.com for real money play.  The hearing is scheduled to begin at 2pm.
